A woman ordered a 'Motu Patlu Kids Rakhi' on August 2, 2019 for her nephew via the Amazon e-commerce portal. The rakhi worth Rs 100 was slated for delivery between 8 and 13 August 2019. However, the sacred threads never arrived for the Rakhi fest on 15th of August, 2019, disappointing the woman. The most bizarre part of the undelivered Rakhi is not that it never came but that the tracker ID showed it having shipped on July 25th! A whole 10 days prior to the actual order?
Even more bizarre was that the tracker ID showed a courier partner that was defunct. On August 14, 2018, Amazon cancelled the order and refunded the amount to the woman's account. Having come across similar complaints by several other users, the disgruntled woman decided to file a legal complaint. The legal notice demanding compensation for the festive frustration saw no response. The woman further approached the District Consumer Disputes Redressal Commission (DCDRC) in Mumbai for relief, seeking compensation worth Rs 4.5 lakhs.
While Amazon opposed the claim, the commission found that the firm accepted the order and refunded whilst never actually paying the seller named Dhanashree Rakhi. Declining the staggering compensation plea, the forum penalized Amazon with Rs 30,000 as compensation for the woman. The commission also directed the ecom giant to cover the complainant's legal costs worth Rs 10,000. Remarking on the order, the commission stated that the deficiency in service caused emotional hurt and she is entitled to reasonable damages.
